Pedestrian Struck – NIPISSING WEST OPP LAYS EIGHTH IMPAIRED DRIVING CHARGE OF 2021

(WEST NIPISSING, ON) – On February 2, 2021 at 1:36 p.m., members from the Nipissing West Detachment of the Ontario Provincial Police (OPP) investigated a motor vehicle collision that struck a pedestrian on Front St., West Nipissing (Sturgeon Falls).

Nipissing Paramedic Services transported the pedestrian to the local hospital with minor non-life threatening injuries.

During the investigation, it was determined that the driver was impaired. The driver was arrested and transported to the North Bay OPP Detachment for further testing.

As a result of the investigation, the driver, Dayna DESMOULIN, 33-years-of-age, from Marathon, was charged with:

Operation while impaired – alcohol and drugs, contrary to section 320.14(1)(b) of the Criminal Code (CC);
Operation causing bodily harm, contrary to section 320.14(2) of the CC;
Take Motor Vehicle Without Consent, contrary to section 335(1) of the CC; and
Driving while under suspension, contrary to section 53(1) of the Highway Traffic Act.

The accused was released on an Appearance Notice and is scheduled to appear at the Ontario Court of Justice on February 25, 2021, in North Bay.

The accused was issued a 90-day Administrative Driver’s Licence Suspension (ADLS) and the vehicle was impounded for seven days.

This incident marks the eighth driver charged under the criminal impaired driving laws in the Nipissing West Detachment area in 2021.
